Schedule A, Group I green cards

The Department of Labor's Schedule A, Group I, pre-certifies registered nurses and physical therapists. That designation lets the employer skip the PERM recruitment and labor-certification process that other EB-2 and EB-3 cases have to complete. The employer still files Form I-140. The nurse or therapist still needs the license the state requires and a VisaScreen certificate.

Schedule A does not remove the visa bulletin. If the category is backlogged, the wait after I-140 approval still follows the priority date. Premium processing, when USCIS offers it for the I-140, shortens the petition stage only.

Physicians and medical researchers

Physicians and researchers in the Research Triangle and Dallas-Fort Worth use several routes, depending on the employer and the current status:

  • H-1B cap-subject. A petition counted against the annual cap, including the lottery when the cap is oversubscribed.
  • H-1B cap-exempt. Institutions of higher education, and certain nonprofit or governmental research organizations related to them, can file outside the cap. A nonprofit hospital is cap-exempt only when it meets that rule. Employment at a hospital does not, by itself, make the petition cap-exempt.
  • O-1. For physicians and researchers whose record meets the extraordinary-ability standard. It is not a shortcut around a weak H-1B.
  • Conrad 30 J-1 waiver. A state waiver program that lets a J-1 physician work in an underserved area instead of satisfying the two-year home-residence requirement. Each state has its own slots and criteria. A waiver is not automatic.

Hospitals and training programs that need the employer-side process can start with physician immigration for employers.

Schedule A and VisaScreen Questions

What is a Schedule A green card for nurses and physical therapists?

Schedule A, Group I lets a registered nurse or physical therapist skip the PERM labor-certification recruitment. The employer still files Form I-140, and the nurse or therapist still needs the required state license and a VisaScreen certificate.

Do registered nurses need the NCLEX and VisaScreen for a Schedule A green card?

Yes. A registered nurse needs a passing NCLEX result, or the state license that follows it, and a VisaScreen certificate from CGFNS before the I-140 is filed. Physical therapists need the state license and VisaScreen as well.

How long does a Schedule A green card take compared with PERM?

Skipping PERM removes the recruitment and labor-certification wait, which is often the longest part of an EB-2 or EB-3 case. After VisaScreen and the I-140, timing still depends on the visa bulletin and on whether premium processing is used for the I-140. The firm does not promise a specific month count.
