Consultation Terms & Conditions

By booking and paying for a consultation through our online scheduling system or otherwise, you agree to the following terms.
1. Scope of the Consultation
The consultation is a one-time, limited-scope meeting (typically 60 minutes) with Attorney Emanuela Prister. It is intended to:
- Review the basic facts of your immigration situation
- Provide a preliminary assessment of potential options
- Discuss general timelines, processes, and likely next steps
- Answer high-level questions about the immigration process
The consultation does not include:
- Preparation or filing of any forms or applications
- Legal research beyond what can reasonably be done in the allotted time
- Ongoing advice or representation after the consultation ends
- Review of extensive document packages (please bring or send only the most relevant documents in advance)
2. Attorney-Client Relationship
No attorney-client relationship is created by booking, paying for, or attending a consultation.
An attorney-client relationship is formed only if:
- The firm agrees to represent you in a specific matter, and
- You sign a separate written Engagement/Retainer Agreement, and
- Any required retainer is paid.
Until all three conditions are met, the firm has no duty to represent you, protect deadlines, or take any action on your behalf. Information shared during the consultation remains confidential (see below), but it does not create a formal representation.
3. Confidentiality
Information you share during the consultation is treated as confidential to the extent permitted by the applicable Rules of Professional Conduct. However, because no formal attorney-client relationship exists until a retainer agreement is signed, certain formal privileges may not fully attach. We will not disclose the substance of your consultation to third parties except as required by law or with your consent.
4. Payment and Refunds
- The consultation fee is $250 (USD) for a private 60-minute consultation with the attorney.
- Payment is collected at the time of booking through our designated online payment processor.
- Credit toward future fees: If you retain the firm for representation within 30 days of the consultation, the full $250 consultation fee will be credited toward your legal fees/retainer.
- Cancellations & Rescheduling:
- You may cancel or reschedule up to 24 hours before the scheduled start time for a full refund or credit.
- Cancellations made less than 24 hours in advance, or failure to appear (“no-show”), are non-refundable.
- We reserve the right to cancel or reschedule due to emergencies, technical issues, or conflicts. In those cases you will receive a full refund or the opportunity to reschedule at no additional cost.
- Refunds, when applicable, are processed to the original payment method and typically appear within 5–10 business days.
5. Conflict of Interest
Before or at the beginning of the consultation, we will perform a basic conflict check based on the information you provide. If a conflict is identified that prevents us from speaking with you, we will notify you as soon as possible and refund the consultation fee in full. You agree to provide accurate names of all relevant parties (you, spouse/partner, petitioners, employers, etc.) so that a meaningful conflict check can be performed.
6. Technology & Recording
Consultations are typically conducted by secure video (Google Meet) or telephone. You may not record the consultation (audio or video) without the attorney’s prior written consent. We may take notes for internal use.
7. Limitation of Liability
The consultation provides general information and a preliminary assessment only. Immigration law is complex and fact-specific. Outcomes depend on many variables outside our control (USCIS processing, changes in law or policy, completeness of evidence, etc.). Nothing said during the consultation constitutes a guarantee of any particular result.
8. Governing Law
These terms are governed by the laws of the State of North Carolina (and, where applicable, Texas). Any dispute arising out of the consultation shall be resolved in the state or federal courts located in Wake County, North Carolina, or as otherwise required by applicable professional responsibility rules.
9. Changes to These Terms
We may update these terms from time to time. The version in effect at the time you book the consultation will apply to that consultation.
