USCIS Adjusts H.R. 1 Immigration Fees Effective October 16, 2026

USCIS published a Federal Register notice on October 1, 2026, announcing a 3.36% inflationary adjustment to certain H.R. 1 fees for FY 2027, effective for benefit requests postmarked on or after October 16, 2026.

USCIS will apply higher fees to certain immigration benefit requests postmarked on or after October 16, 2026, following a 3.36% CPI-U adjustment published October 1, 2026.

The changes affect fees established under the One Big Beautiful Bill Act (H.R. 1 / Pub. L. 119-21). USCIS calculated the increase using the Consumer Price Index for All Urban Consumers from July 2025 to July 2026. Requests lacking the correct fee will be rejected.

Examples include the annual pending asylum application fee, which rises from $102 to $105. The initial I-589 asylum application fee stays at $100. The parole into the United States fee increases from $1,020 to $1,050. Other affected categories include certain TPS and EAD filings mandated by H.R. 1.

USCIS has updated Form G-1055 (Fee Schedule, edition 10/01/26) to show the new amounts. Applicants and petitioners should confirm the required fee on the current form before mailing any request. Using the prior fee amounts after the effective date will result in rejection and possible delays.

What This Means for You:

  • Key Point: USCIS is raising selected H.R. 1 fees by 3.36% for requests postmarked on or after October 16, 2026.
  • Who Should Be Concerned: Applicants filing asylum-related forms, parole requests, TPS, or certain EADs governed by H.R. 1.
  • Timeline for Action: Verify fees before any mailing with a postmark on or after October 16, 2026.
  • Next Steps: Check the updated Form G-1055 on uscis.gov and include the correct fee with your filing.
