In a major policy shift, the Texas Commission of Licensing and Regulation has adopted a new rule requiring individuals to provide proof of legal immigration status to obtain or renew a professional license. The rule, which takes effect on May 1, 2026, will impact more than 40 regulated programs across various industries, including electricians, cosmetologists, barbers, and healthcare professionals.
The Texas Department of Licensing and Regulation (TDLR) oversees more than one million licensees. The commission stated the rule was approved to comply with a U.S. code restricting eligibility for certain state and local public benefits based on immigration status. While the department claims there will be no adverse economic effect, critics argue otherwise.
Advocacy groups and labor unions, such as the International Brotherhood of Electrical Workers, have voiced concerns that the requirement could lead to a "de-skilling of the workforce" and negatively impact the state's economy. This new rule is part of a broader effort in Texas to implement stricter requirements for immigrants, following recent changes to vehicle registration and voting policies.
