EOIR is accepting public comments on revisions to Form EOIR-59 through October 13, 2026.
The form standardizes requests under the Privacy Act and FOIA to authorize disclosure of EOIR case records, including case files or audio recordings, to attorneys, accredited representatives, or other third parties. Individuals and households who are or have been in immigration proceedings before EOIR use this form when they wish to release their records.
EOIR estimates 87,080 annual respondents, with each response taking about 10 minutes for a total of 14,804 annual burden hours. One substantive change adds a field in Part C for the printed name of a parent or guardian to aid identity verification. Non-substantive edits update instructions, links, the Privacy Act Statement, and remove references to “noncitizen.”
Comments on the proposed three-year extension and revision must be submitted by October 13, 2026, via www.reginfo.gov or to eoir.pra.comments@usdoj.gov. This update appears in the September 11, 2026 Federal Register notice.
