EB-5 Fee Adjustments Effective November 30, 2026

DHS published a final rule on September 30, 2026, adjusting USCIS fees for EB-5 immigration benefit requests and codifying provisions of the EB-5 Reform and Integrity Act of 2022.

USCIS will apply new EB-5 fees to all applications postmarked on or after November 30, 2026.

The final rule adjusts fees for Forms I-526, I-526E, I-829, and the I-956 series while codifying integrity measures from the EB-5 Reform and Integrity Act of 2022. Form I-526 (Standalone Investor) carries a fee of $7,615, which includes a $75 technology fee. Form I-526E (Regional Center Investor) initial filing is $7,850 and amendment filing is $7,775, each including the technology fee. Regional centers must pay annual EB-5 Integrity Fund fees of $11,000 for 20 or fewer investors or $22,000 for more than 20 investors, with amounts adjusted for inflation.

The changes increase fees for approximately 16,600 EB-5 program form filings each year by a weighted average of about 70.7 percent. USCIS states the new fees support full cost recovery for program administration, statutory processing times, and integrity measures such as audits and site visits. The rule addresses public comments received on the October 23, 2025 proposed rule and applies to EB-5 immigrant investors filing petitions through standalone investments or regional centers, as well as regional center operators and applicants.

Investors and regional centers should review current filing plans against the November 30, 2026 effective date. Petitions postmarked before that date may use existing fees, while later filings require the updated amounts. Parties should confirm exact fee calculations with USCIS resources before submission.
