DHS Terminates Temporary Protected Status for Yemen; EADs Expire May 4, 2026
The Department of Homeland Security has officially terminated Temporary Protected Status (TPS) for Yemen, with all TPS designations and related benefits expiring on May 4, 2026, at 11:59 p.m. The termination was announced by then-Secretary Kristi Noem, who determined that conditions in Yemen no longer meet the statutory requirements for TPS and that it is contrary to the national interest to permit Yemeni nationals to remain temporarily in the United States under that designation.
TPS provides protection from deportation and work authorization to nationals of countries experiencing ongoing armed conflict, environmental disasters, or other extraordinary conditions. Yemen has been designated for TPS since 2015 due to the country's devastating civil war, which has created one of the world's worst humanitarian crises.
Employment Authorization Documents (EADs) bearing a category A12 or C19 with Card Expires dates of March 3, 2023; September 3, 2024; or March 3, 2026, issued under prior Yemen TPS designations are now valid only through May 4, 2026. Yemeni TPS holders do not need to present a Form I-797 or I-797C receipt notice alongside their EAD to establish the new validity period.
Following termination, Yemeni nationals who held TPS and have no other lawful immigration status will be subject to removal proceedings. USCIS's SAVE system will return a "No Status" response for individuals whose TPS has expired and who have no other lawful basis to remain. Affected individuals may still have other avenues for relief, including asylum, withholding of removal, or other pending applications.
